Terms of use
Last updated:[date]See also the Privacy policy.
These terms are a contract between you and Igor Lobanov, an independent developer based in Baku, Azerbaijan, who operates NutriSee (“we”, “us”). You accept them by ticking the box when you create an account, and by using the app. Our Privacy policy is part of these terms. If you do not agree with them, do not use NutriSee.
1. Who can use NutriSee
You must be at least 18 years old and able to enter into a contract. You may create one account, with accurate information, and you are responsible for everything done with it.
2. What NutriSee is, and what it is not
NutriSee is a food and weight diary. You log meals from a photo, a typed description, a search, a barcode, by hand or from a saved meal. The app estimates ingredients, portions, calories and macros, shows you the estimate, and adds it to your diary only after you confirm it. You can record your weight and set targets, and the app shows how the two relate over time.
Estimates are estimates. Everything the app shows you is an approximation. Section 3 explains where the numbers come from, how they can be wrong, and what you must never rely on them for.
NutriSee is not medical advice. It does not diagnose, treat or prevent any condition, and it does not replace a doctor, dietitian or other professional. The targets it calculates are general-purpose arithmetic from the details you enter, not a prescription. Talk to a professional before changing your diet if you are pregnant or breastfeeding, have a medical condition, take medication that interacts with food, or have a history of disordered eating. If tracking makes you feel unwell, stop and seek help.
3. Accuracy of data
Everything NutriSee shows you is an estimate, and you should treat it that way.
- Photo and description analysis is produced by a machine-learning model. It can misidentify foods, miss ingredients, misjudge portions, and give different results for the same meal.
- Product and barcode data comes from Open Food Facts, a database maintained by volunteers. Entries can be wrong, incomplete or out of date, a barcode can be matched to a different product or to a different regional version of the same product, and serving sizes may not match what you ate. We do not verify this data.
- Search results, saved meals and manual entries carry whatever values were entered, by you or by someone else, with no check against the real food.
- Targets, averages and progress figures are arithmetic on the estimates above and inherit their errors.
Nothing in NutriSee is a source of truth. It is a tool for noticing patterns, not a measurement. Do not rely on it for anything where an error could harm you: allergens, intolerances, ingredients you must avoid for medical or religious reasons, medication that depends on food intake, or any medical decision. Read the packaging and ask a professional. You decide what to confirm, and you are responsible for the decisions you make based on your diary.
4. Your account
You can sign in with an email address and password, or with your Apple or Google account. Keep your sign-in details to yourself and tell us straight away at support@nutrisee.app if you think someone else has used your account. We may ask you to sign in again before sensitive actions such as deleting the account.
You can delete your account at any time from Settings → Account. Section 9 of the Privacy policy explains what happens then.
5. NutriSee Pro
Buying. NutriSee Pro is a subscription sold through the Apple App Store and Google Play. The store takes payment, issues receipts and applies its own terms alongside these. Prices are shown in the store in your local currency before you buy.
Plans and trial. Pro is offered monthly and yearly. Where a free trial is shown, it lasts 7 days and is available on the yearly plan, once per person. The trial becomes a paid subscription unless you cancel at least 24 hours before it ends.
Renewal and cancellation. Subscriptions renew automatically for the same period until cancelled. Cancel in your App Store or Google Play subscription settings at least 24 hours before the current period ends. Cancelling stops the next charge; you keep Pro until the period you have paid for runs out. Deleting the app or your account does not cancel the subscription.
Refunds. Payments are taken by Apple or Google and refunds are handled by them under their policies. We cannot issue refunds ourselves. If you live in the EU or the UK you may have a statutory right to withdraw within 14 days of purchase; the store’s refund process is the way to exercise it.
What Pro includes. A new account starts with a trial or a Pro subscription. Pro unlocks photo and description analysis and everything else in the app. If your subscription ends, you keep your account and your history, and you can still log by search, barcode, manual entry and saved meals, record weights and manage your plan. Photo and description analysis need an active subscription.
One account, both platforms. Your subscription belongs to your NutriSee account and works on iOS and Android when you sign in with the same account. Billing stays with the store where you bought it, so manage or cancel it there. If the app does not recognise a purchase you made, use Restore purchases in Settings.
Price changes. If we change the price of a plan, the store will tell you in advance and you can cancel before the new price applies.
6. Fair use of analysis
Every photo and description analysis costs us money. We may apply reasonable limits on how many analyses an account can run in a period. If a limit applies to you, the app shows it. We may slow down or refuse automated, bulk or clearly abusive use.
7. Your content
Your photos, descriptions, entries, weights and settings are yours. So that NutriSee can work, you give us permission to store them, make backups, send photos and descriptions to our analysis provider, show them back to you, and use de-identified versions to improve the service and train models under the limits in section 7 of the Privacy policy. This permission ends when you delete the content or your account, except for the retention periods described there.
You confirm that you have the right to upload what you upload. Photograph the food, not other people. Do not upload anything unlawful, or anything intended to abuse or probe the analysis service. We may remove content that breaks these terms.
8. Acceptable use
You agree not to:
- use NutriSee for anything unlawful;
- share an account, sell access to it, or let anyone under 18 use it;
- get around the subscription, trial limits or analysis limits;
- access the service other than through the app, for example with scripts, scrapers or by calling our servers directly;
- copy, modify, reverse engineer or decompile the app, beyond what the law expressly allows;
- interfere with the service, probe its security or load it deliberately;
- impersonate anyone or misrepresent your connection to NutriSee;
- resell, rent or redistribute the service or data from it.
9. Our content and third-party data
The NutriSee app, website, name, logo, design, text and the instructions we give the analysis model belong to us or our licensors. We give you a personal, non-transferable licence to use the app on your own devices for your own tracking. Everything else is reserved.
Product data comes from Open Food Facts and is made available under the Open Database License; individual contents are under the Database Contents License. Attribution and the open-source components the app uses are listed on our Licences page.
10. Third-party services
Apple, Google and the other providers named in the Privacy policy run their own services under their own terms. We are not responsible for them, and your use of them is between you and the provider.
11. Changes to the service and availability
We improve NutriSee continuously, which means features will change, and some may be removed. We may suspend the service for maintenance or security. If we discontinue NutriSee or remove a core paid feature, we will give you at least 30 days’ notice where we reasonably can, and you can cancel your subscription. We do not promise that the service will be available without interruption.
12. Ending the agreement
You can end it at any time by deleting your account. Cancel your subscription in the store first.
We can suspend or close your account if you break these terms, if we suspect fraud or abuse, or if the law requires it. Where it is reasonable to do so we will tell you first and give you a chance to respond. Once the agreement ends you lose access to the service; your data is handled as described in the Privacy policy. Sections 3, 7, 9, 13, 14, 15, 17 and 18 continue to apply.
13. Warranties and disclaimers
NutriSee is provided as it is and as it is available. We do not promise that analysis results, product or barcode data, search results, targets, progress figures or any other output are accurate, complete, current or fit for a particular purpose, or that using the app will produce any particular result for your weight or health. Nothing in this section limits rights that consumer law gives you and that cannot be excluded.
14. Liability
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that the law does not allow us to limit.
Otherwise we are not liable for losses that were not a foreseeable result of our breaking these terms, for business losses, or for losses that come from relying on analysis results, product or barcode data, targets or progress figures, all of which section 3 says are estimates. We are not liable for the acts or outages of the app stores, sign-in providers or other third-party services.
Our total liability to you for all claims in any 12-month period is limited to the amount you paid for NutriSee Pro in the 12 months before the claim, or €50 if you paid nothing.
15. Governing law and disputes
These terms are governed by the laws of the Republic of Azerbaijan. If you are a consumer in the European Union, the United Kingdom or another country whose law gives you protections that cannot be waived, you keep those protections, and you may bring a claim or be sued only in the courts of the country where you live.
If you have a problem, email support@nutrisee.app first. We will try to resolve it within 30 days. Nothing in these terms requires arbitration or stops you from using a dispute-resolution body available to consumers where you live.
16. Changes to these terms
If we make a material change, we will email you and show a notice in the app at least 14 days before it takes effect. If you do not agree, cancel your subscription and delete your account before that date. Using NutriSee after the date means you accept the new terms. Smaller changes, such as clarifications, take effect when posted. The date at the top of this page shows the current version.
17. General
These terms and the Privacy policy are the whole agreement between you and us about NutriSee. If a court finds part of them unenforceable, the rest still applies. If we do not enforce a term, we can still enforce it later. You may not transfer this agreement to anyone else; we may transfer it to someone who takes over NutriSee, and we will tell you if we do. These terms are written in English, and the English text governs any translation.
18. Additional terms for the Apple App Store
If you downloaded NutriSee from the Apple App Store, these points also apply.
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- The licence in section 9 lets you use the app on Apple devices that you own or control, as the App Store’s usage rules allow.
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any.
- If the app fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price to you. To the extent the law allows, Apple has no other warranty obligation, and any other claim, loss or cost arising from the failure is our responsibility.
- We, not Apple, handle any claim relating to the app, including product-liability claims, claims that the app does not meet a legal or regulatory requirement, and consumer-protection or similar claims.
- If someone claims that the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a United States government embargo or designated by the United States as a “terrorist supporting” country, and that you are not on any United States government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Google Play has no equivalent requirement. The Google Play Terms of Service apply to purchases made there.
